Speakers Megan Brown Partner Wiley Rein LLP formerly with the U.S. Justice Department Matthew Gardner Partner Wiley Rein LLP former federal prosecutor Gus P. Coldebella Partner Fish & Richardson former acting General Counsel, U.S. Department of Homeland Security   Info Date: March 13, 2018 Time: 2 – 3:35 P.M. ET Duration: 95 minutes Fee: Complimentary with registration LexisNexis CLE Questions:   Is Our Critical Infrastructure Cyber Resistant? Scientific American recently published an article which concluded that while our power grid and most of our infrastructure is pretty well built, it was not constructed with cybersecurity in mind. And our adversaries are pouring it on, the article says, learning about our industrial computer networks and, more urgently, how our industrial engineering systems can be disrupted or torched. “That’s where you start reaching some particularly alarming scenarios,” Scientific American says. Writing for Law360®, Wiley Rein LLP partner and former U.S. Justice Department attorney Megan Brown, along with her colleagues Matthew Gardner and Michael Diakiwski, agreed that our adversaries continue to be aggressive. They cited the WannaCry malware attack from North Korea, an event that whipped up a “flurry of federal cybersecurity activity” in December. And we can expect a busy 2018, the Wiley Rein attorneys wrote, with review of national security strategy and executive orders, policymakers considering how to secure the internet [...]

Healthcare Cyber Attacks 2017 Report from CryptoniteNXT

February 10th, 2018|Categories: HB Risk Notes|Tags: , , , , , |

In boxing your trainer will tell you to keep your eyes open and your head and feet moving. After all, it's way harder to land a solid punch on a moving target. According to the Healthcare Cyber Research Report for 2017 by CryptoniteNXT the same is true for healthcare organizations. In just the ransomware category alone, they experienced an 89% increase of attacks last year. "Health care networks will remain under persistent attack by cyberattackers that target their valuable data through the use of well understood vulnerabilities," the CryptoniteNXT report reads. "It becomes imperative to deploy a comprehensive strategy both to detect and deter the sophisticated attacker moving through the network, as well as the multitudes of ransomware tools that they will deploy into 2018 and 2019." "New best practices and the technologies that support them," the report continues, "such as moving target cyber defense (MTD) and network micro-segmentation, can detect and defeat many of the attacks leveraged by vulnerabilities found in most health care networks. MTD and network level micro-segmentation technology sets can directly address the inherent weakness in TCP/IP networks. By building out a Zero Trust environment health care institutions can directly address the top vulnerability use cases that exist in their networks today. The decision to deploy moving target cyber defense and network micro-segmentation technologies shut down reconnaissance and [...]

Is Cyber War the Same as Actual War?

January 31st, 2018|Categories: HB Risk Notes|Tags: , , , , |

If your company suffers a cyber attack attack by a foreign power, is that an act of war? Is it your responsibility or right to retaliate, or is it up to the government? When it comes to missile attacks, it's not up to a corporation to fire back. That's the military's job. But when it comes to cyber defense, the responsibility falls to the corporation. Should it be a shared responsibility? Can we better defend ourselves with an improved cyber defense architecture that is developed by a public-private partnership? General (Ret.) Keith B. Alexander (U.S. Army), Jamil N. Jaffer and Jennifer S. Brunet of IronNet Cybersecurity recently wrote an article on the subject, offering insights based on their deep experience in the intelligence, defense and government sector. Gen. Alexander, among many other posts, was Director of the U.S National Security Agency when he was tapped to head the U.S. Cyber Command. Jaffer was counsel on cybersecurity to the White House, the U.S. Senate and the U.S. Department of Justice. Brunet is former Protocol Officer with the NSA. They say the situation is an urgent one that must be addressed ASAP. "When it comes to understanding what might constitute acts of war in cyberspace," they write, "it is easy to imagine categories of cyberattacks with consequences that we would likely be prepared to [...]

Will Blockchain Sweep the Legal Industry?

January 28th, 2018|Categories: HB Risk Notes|Tags: , , , |

"[I]t is clear that [blockchain] technology has the potential to be massively transformative and disruptive for the legal industry. Even the most basic examples illustrate how blockchain could provide answers for some of the fundamental questions attorneys have grappled with since the dawn of the profession. While the days of full-scale adoption may be well off, it would certainly behoove attorneys to stay abreast of developments in both blockchain and cryptocurrencies." --Matthew Decker, Associate, McBreen & Kopko, writing in the Philadelphia Legal Intelligencer       Attorneys should stay abreast of developments in blockchain? We couldn't agree more, Matthew!

Hildebrandt: Law Firms Must Consider Cyber Sector Risks

January 24th, 2018|Categories: HB Risk Notes|Tags: , , , |

In its 2018 Client Advisory, Hildebrandt Consulting LLC, shared insights and trends we've come to expect from this leading monitor of the legal market. For example, the report says that while revenues grew in the legal market, that was due in part to increased fees in the face of declining demand. It's important to consider . . .  the sectors in which the firm does business." The Advisory also discussed cybersecurity, something firms must pay attention to since they are a sweet, sweet target for hackers and for good reason when you consider all the intellectual property, deal documents, evidence, and other juicy info that rests on law firm servers.  The report said firms need to determine their own "unique risk profile." They say it's important for firms to know who has access to sensitive data, whether employees use mobile devices for work, who is in charge of IT security and the business sectors in which the firm advises clients.  "Understanding the unique risks of the firm is crucial to tailoring an effective security plan." Hildebrandt encourages firms to "master the fundamentals" of cybersecurity. "Hackers often take the path of least resistance when it comes to targeting law firms. While many firms may not have the resources to implement state-of-the-art security, most firms can implement some fundamental security measures that will deter [...]
