E-Discovery

Federal electronic discovery rules were amended just over a year ago, significantly changing federal practice in this area.  Over the past year, numerous courts throughout the country have issued decisions that clarify parties’ responsibilities under the rules and provide guidance to litigants engaged in electronic discovery in federal court.

We will review the new rules and recent caselaw, and analyze their impact with respect to:

  • Amended Rule 26 and the scope of allowable discovery
  • Amended Rule 34 as it relates to discovery responses and objections
  • Amended Rule 37(e) and the ability of a court to issue sanctions

Then we will discuss the operational and practical aspects of conducting e-discovery smoothly with the least disruption to the client, using data analytics to solve key problems.
