Given that the NLRB has indicated its intent to target social media policies aggressively, employers should avoid running afoul of the NLRA by crafting social media polices that restrict an employee’s right to discuss wages and working conditions. While experts in this area believe that the GC’s stance will be challenged in the courts, employers should make a renewed effort to stay out of the NLRB’s crosshairs.
